Terms and Conditions applicable to the DotJewellery.com website
These Terms and Conditions set out the terms and conditions governing your use of the DotJewellery.com website and any contract for the supply of products by DotJewellery.com to you. If you are a consumer (within the meaning of the Unfair Contract Terms Act 1977), the content of these Terms and Conditions will not affect your statutory rights.
Your attention is also drawn to DotJewellery.com's individual product specifications, Product Information and Privacy Policy Statement, which should all be read in conjunction with these Terms and Conditions.
Interpretation
Unless the context otherwise requires, the following words or phrases used within these terms and conditions shall have the following meanings:-
- "DotJewellery.com", "us" or" we" means DotJewellery.com a retail outlet business of L K Matthews Ltd of The Green, Rhossili, Gower, Swansea, SA3 1PL. DotJewellery.com and L K Matthews Ltd are here together considered one and the same.
- "Customer" or "you" or "your" means the person, firm or company placing the order and completing the payment card transaction, or by any other means of payment, with us.
- "Products" means jewellery or other products which DotJewellery.com is to supply in accordance with these Terms and Conditions.
- "Website" means the DotJewellery.com website at www.dotjewellery.com.

Delivery
The estimated dispatch times for products are indicated on the individual product pages underneath the price and specifications. For example, most popular plain wedding rings are dispatched within a week, other plain rings and patterned wedding rings are dispatched in around 2 weeks with some more unusual styles 3 weeks. As circumstances vary by season, in extreme instances please allow up to 20 working days for dispatch. If your order is urgent or required sooner, please write the date it is required for in the comments box in the checkout or contact us before ordering and we will be able to assist you. It is important that you let us know the date an order is required for if it is coming up shortly to ensure it will arrive in time.
An additional allowance of up to five days should be made for personalised items with engravings and for items with special finishes such as matt finishes on rings. Typically it is quicker than this time.
For special orders and non-standard products: prices for these items and delivery details will be quoted for at the time of acknowledgement of the enquiry unless otherwise specified.
All orders dispatched to UK addresses are usually sent by Royal Mail's Special Delivery Service which is a next day delivery service to most parts of the UK. For more information on specific delivery time to areas please visit Royal Mail's website by clicking here. Royal Mail International Tracked and Signed or another similar courier will be used to dispatch orders to Ireland, Europe and the rest of the World. This may require a signature upon receipt; do not worry if no one is in when they try to deliver as the courier will leave a note regarding alternative collection / delivery arrangements. An allowance of 5 working days should be allowed for postal delivery to other EU countries. On the day of posting you should receive a dispatch notification e-mail giving you the tracking number for your parcel.
A finger-size measuring gauge is supplied after order placement for use to recheck finger size and for use with further purchases from us.
We are able to dispatch goods to addresses other than an address registered to the payment card so long as the payment passes online security checks with your card issuer. For orders placed over the telephone items can only be dispatched to the card holders registered address.
We shall be under no liability for any delay in delivery or non-delivery due to circumstances beyond our control.
If the parcel / product is lost or found to be damaged upon receipt then we advise you to contact Royal Mail and dotJewellery.com as soon as possible and damaged item(s) returned to us for replacement. See below for our Returns Policy.

Packaging
All items will be packed in a dotJewellery.com or Rhossili Gallery branded presentation jewellery box and will be suitably packaged to prevent damage in transit. When an order is placed for two wedding rings for example these will be presented in a double ring box.
Postal packages do not have any reference as to what is inside them nor do they have printed on them our company name or logo.
Insurance
dotJewellery.com provide product insurance to items whilst in transit delivery only up to the point of customer's signed receipt.
It is the customer's responsibility for appropriate insurance cover thereafter.
Special Orders
Special Orders fall into three categories: bespoke designs, rings and items in non standard sizes and items that are personalised with engraving. These items are subject to a restricted returns policy. Details can be found below.
Special Offers
Any special offers by dotJewellery.com from time to time are made strictly on the following conditions:
- No cash alternatives
- Subject to availability
- Excludes items made to special order
- Not available in conjunction with any other offer
- Offer limited to one offer per Registered Customer
Your Right to Cancel
You have the right to cancel this contract within 30 days without giving any reason.
It is helpful in developing our customer care if you could let us know your reason for cancelling but it is not obligatory.
Cooling off Period
The cancellation period will expire after 30 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires physical possession of the goods.
Certain items are excluded from the 30 days cooling off period period such as items intended for piercings, engraved items, personalised, bespoke and special order items. See below for full details.

To exercise the right to cancel, you must inform us of your decision to cancel this contract with a clear statement of intent (e.g. a letter sent by post or e-mail). You may use our contact form.

Deadline
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
Effects of Cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
We will make the reimbursement without undue delay and not later that -
(a) 14 days after the day we receive back from you any goods supplied, or
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you and dotJewellery have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
Personalised and Engraved Items
Your right to cancel does not apply to orders for pierced jewellery where packaging has been opened, engraved items, special order rings made in sizes outside of the standard size range displayed on our website or special order jewellery that has been made to a customers specific design. This does not affect your statutory rights.
Items that have been made to special order or engraved with messages or other text or symbols that a customer provides with an order, will be a unique item that is made specifically for that customers order.
Rings can however be amended in size and other amendments can usually be accommodated.
Returns and Exchanges
Exchange of Product
In the event that any product ordered does not fit the recipient or is not suitable, please contact us within 30 days immediately after the date of the relevant signed delivery receipt to arrange for an exchange in a different size and/or alternative item. This includes rings that have had personalised engraving or special finishes if it is within a couple of sizes. You can contact us by phone on 01792 391 300 if you have any questions, need advice or would like to discuss any aspect of your order.
Return of Goods
Alternatively, if you are dissatisfied with your purchase then please contact us within 30 days immediately after the date of the relevant signed delivery receipt to inform us of your intention to return the item(s). We recommend that you inform us by a written medium such as e-mail. We will issue your refund as soon as possible within 14 days.
You shall send back the goods or hand them over to us at Rhossili Gallery, The Green, Rhossili, Gower, Swansea, SA3 1PL, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
When returning your item(s) we recommend that you use the presentation box and padded envelope that the item(s) arrived in to ensure that it does not get damaged during transit to us; this is the customer's responsibility.
For hygienic and health and safety reasons all jewellery designed for body piercing, such as earrings will not be accepted for return if they are unpacked.
We are unable to accept back for refund any item that has been personalised or engraved. This does not affect your statutory rights. Any item which has been specifically personalised, such as engraved dates, names or any other form of text or symbols or bespoke design, will not be eligible for the same return policy as other non-personalised items. This equally applies to outsize rings and items made to special order. (Outsize rings are those that fall outside the range listed in the appropriate individual product size dropdown). We are however able to make size adjustments to an engraved or special order ring should a ring not fit.
If the parcel / product is lost or found to be damaged upon receipt by you, i.e. whilst in transit, then both the Royal Mail and dotJewellery.com must be informed without delay and any damaged item(s) returned to us for replacement within seven days immediately after the date of the relevant signed delivery receipt. dotJewellery.com shall not be deemed in breach of its obligations provided replacement products have been supplied.

It is the customer's responsibility for appropriate insurance cover to be obtained when returning goods to dotJewellery.com and the use of Royal Mail's 'Special Delivery Service' is strongly recommended for returns on mainland UK and the use of an equally reliable courier service when being returned from elsewhere. Please remember the goods belong to you until we receive them.
Consumer's Liability for Diminished Value of the Goods
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Warranty
Although unlikely, should an item show a defect in material or workmanship we will gladly exchange or refund on return of the faulty product(s) within twelve months from delivery. dotJewellery.com will use its own discretion in replacing these damaged goods and we will not credit or replace items that have been ill treated or suffered damage through normal wear and tear or where an attempt to repair has been made by any third party.
Liability
dotJewellery.com gives no warranty or representation as to the accuracy, suitability or reliability of the information or content of the website for any purpose. Any such information or content is provided on an “as is” basis without warranty of any kind and, except where the website is being used by a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties and conditions (including all warranties and conditions implied by law as to title, satisfactory quality, fitness for purpose and non-infringement) are expressly excluded in this respect.
We do not accept liability for any typographical, clerical or other errors and/or omissions and reserve the right to add, delete, and modify any of the information found on the web site at any time without notice.
We will not accept liability for any direct, indirect, special or consequential loss arising out of the use of or the inability to use the web site including without limitation, reliance on any information or service obtained from the website or which results from mistakes, omissions, interruptions, deletion of files or e-mail, errors, defects, viruses, delays in operation or transmission, or any failure of performance whether or not limited to Act of God, communications failure, theft or destruction, save that liability for death or personal injury arising from the negligence of dotJewellery.com is not limited or excluded.
Subject to the following provisions dotJewellery.com warrants that any products supplied will correspond with any applicable specification at the time of delivery and will be free from defects in material and workmanship for a period of twelve months from delivery. This warranty is given subject to the following conditions:
(a) dotJewellery.com shall be under no liability in respect of any defect in the products arising from any specification or instructions by you or errors or inadequacies in the same;
(b) dotJewellery.com shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage or alteration or repair of products without our approval;
(c) the above warranty does not extend to products not manufactured by dotJewellery.com in respect of which you will only be entitled to the benefit of any such warranty or guarantee as is given by the manufacturer to dotJewellery.com.
Subject as expressly provided in these Terms and Conditions, and except where products are sold to a person dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law in respect of any products supplied by dotJewellery.com.
Where we have replaced defective products or products failing to meet specification, or refunded to you the price of such products (or a proportionate part of the price), dotJewellery.com shall have no further liability to you.
Except in respect of death or personal injury caused by our negligence, or liability for defective products under the Consumer Protection Act 1987, dotJewellery.com shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law or under these Terms and Conditions for loss of profit or for any indirect, special or consequential loss or damage, costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of dotJewellery.com, its employees or agents or otherwise) which arise out of or in connection with the supply of products (including any delay in supplying or any failure to supply products in accordance with these Terms and Conditions or at all) or their use or re-sale by you and the entire liability of dotJewellery.com under or in connection with the supply of products shall not exceed the price of the products.
dotJewellery.com shall not be liable to you by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products, if the delay or failure was due to any cause beyond our reasonable control.
Jurisdiction, Entire Agreement and Severability
Every purchase you make shall be deemed performed in England and Wales. The Law of England and Wales shall govern these Terms and conditions and every aspect of contractual agreement concerning purchases made from us and dotJewellery.com and the customer submit to the non-exclusive jurisdiction of the Courts of England and Wales.
These Terms and Conditions and Privacy Policy contain the entire agreement between you and dotJewellery.com relating to your purchase and supersede all previous agreements and understandings between us.
The invalidity or enforceability of any term shall not affect the validity or enforceability of any of the other terms. If any provision of these Terms and Conditions is or becomes invalid or contravenes any applicable law in whole or in part, the offending provision or part thereof shall be severed and the remaining provisions and the remainder of the affected provision shall remain in full force and effect.
Legal
All products sold by dotJewellery.com shall remain the property of dotJewellery.com until payment of the total product invoice amount.
You undertake that all details you provide us for the purpose of ordering or purchasing products (including any applicable specification) are correct, that the credit or debit card you are using for the purpose of ordering or purchasing products is your own and that there are sufficient funds to cover the cost of the product or service being purchased.
If there are any changes to the details supplied to us by you it is your responsibility to inform dotJewellery.com within a reasonable period after supply of such details. We shall have no liability to you arising from your failure to do this.
Confirmation of receipt of your order by e-mail, does not guarantee the product sale.
For credit card purchases your account will be charged for the products selected with the prices displayed at the moment of your order acceptance. For all other methods of payment orders will commence manufacture process on credit clearance confirmation.
dotJewellery.com reserves the right to add to, delete from, and modify these Terms and Conditions at any time without any prior notice. Please visit these Terms and Conditions prior to purchasing each order.
Purpose of Access
Access to this website is made available for the purpose of allowing you to view, copy, print and distribute documents available and order products, subject to the following conditions:
(a) access is given solely for personal and non-commercial use;
(b) any document or other element of the content of this website which is downloaded must not be modified or altered in any way or used for any commercial purpose; and
(c) dotJewellery.com reserves the right to revoke the right to access the website and to use its contents in the manner specified at any time, whereupon you agree to discontinue access and use forthwith.
